The Constitution or Magna Carta, approved in 1978, is the center of the political system and legal system in Spain. Aristotle says: It is dangerous that power is not regulated by laws and that it is exempt from all responsibility (priviledges). Holding the privileged to account is a healthy principle to avoid corruption of power and enrichment in the exercise of office. This is undoubtedly the purpose of our association to denounce, disclose all violations and misuses that threaten it. Without a doubt the most worrying are the privileges that the most powerful citizens have assumed for themselves for 39 years
Political power is an essential element of the State, which was created by man for his own welfare, let us discard the idea that power is synonymous with evil, exploitation and simple and pure domination. For this reason we think that power is synonymous with direction. That is to say, we consider that those who exercise political power (the authority of the State) are those who have the duty to direct society towards the goal of maintaining the State united, balanced, etc.
However, a political power without control or responsibility (the one granted by the privileges of privileges) falls into numerous defects:
Misgovernment: which manifests itself as selfish interests of its authors instead of the common good promulgated by Aristotle.
Excess and Abuse of Power: authoritarianism, totalitarianism, despotism, tyranny, etc., which results in restriction of freedoms, infringement of citizens' rights in favor of a few.
- Autocracy: when there is no control against power and it possesses the absence of accountability (privileges).
- Authoritarianism: coexists with civil society as long as it does not jeopardize the exercise of political power.
Individual rights and constitutional guarantees are the fundamental core of a constitutional State, and represent a space of individual self-determination in which the State cannot intervene, and are also a sphere of protection against the Power exercised by it.
The big unanswered questions (yet):
- Why has art.14 of our constitution been violated by creating the 240,000 priviledges?
- Why do those who hold these privileges (5,408 judges in Spain in 2022) not denounce their unconstitutionality to which they are obliged by LOTC 35.1?
- Why does no one except our association seek its elimination and reestablishment of compliance with art.14 of the Magna Carta?
The most surprising thing is that Aristotle's ideas are applicable to the political power of our country today, because in Greek times there were social classes: free/slaves, citizens/non-citizens.... but in Spain, weren't we all equal in the law? ;-)
